Today we achieved an appellate victory on behalf of remote workers bringing discrimination cases in California. In Malloy v. Superior Court, the Court of Appeal confirmed workers' right to bring suit where they live & work, rather than where their employer is based. The Court further found that employees may bring suit for interference with leave rights in the venue where they exercised (or attempted to exercise) those rights. Margaret Wright and Julian Burns King advocated on behalf of our client, whom we allege was fired when she was unwilling to return to work in the middle of her job-protected pregnancy disability leave. While many firms would have accepted the order transferring venue and moved on with litigation, Margaret and Julian filed a writ petition and won an order transferring the case back to Los Angeles, where our client lives and worked before her allegedly wrongful termination. These procedural victories are important for plaintiffs, especially in the era of remote work. We're proud to share that a Riverside County jury awarded approximately $950,000 in compensatory damages to two of our clients. Both clients worked in Human Resources at Green Thumb Produce, a produce distributor, and complained of wage gaps and discriminatory treatment against women and minorities at the company. They were fired immediately after making these protected complaints. After two years of rigorous litigation and a three-week trial, justice prevailed. The jury ruled in favor of our clients on their retaliation claim, firmly rejecting Green Thumb's claim that our clients resigned and suffered no adverse employment actions. Robert King, Rachael Sauer, and Priscilla Hernandez were trial counsel, assisted by veteran paralegal Josue Avila. We are thrilled for our clients and we hope that this verdict will send a message to employers in the Inland Empire that they cannot ignore employee concerns about illegal behavior.
