marriage in Illinois and Gov. Pat Quinn signed the bill into law on November
20, 2013. Palatine family law attorney Michael A. Meschino welcomes the
opportunity to assist Illinois same-sex couples with their family law and
marital planning needs.
With the passage of Illinois’ same-sex marriage law, Illinois joins a growing number
of states that also allow same-sex marriage, including California, Connecticut,
Delaware, Hawaii, Iowa, Illinois, Maine, Maryland, Massachusetts, Minnesota,
New Hampshire, New Jersey, New Mexico, New York, Rhode Island, Vermont, and
Washington, as well as Washington, DC.
When the law takes effect on June 1, 2014, same-sex couples will be subject to
the marriage, divorce, and other family law provisions of the Illinois Marriage
and Dissolution of Marriage Act, just like any other married couple. For instance,
same-sex couples will have the right to marry, divorce, hold property as
tenants in the entirety, make medical decisions on behalf of spouse, inherit
property from spouse, sponsor a foreign national same-sex spouse for a green
card, receive employee benefits from spouse, and be protected from creditors
for marital home.
