Role of a Witness in a Personal Injury Case

04/09/2018 If you have been injured and are pursuing a personal injury case to recover damages for your injuries, you will need evidence, proof, and liability to determine negligence. A witness to your accident can provide important testimony that supports elements of causation, liability and damages and ensures a successful claim.
If an individual has witnessed your accident, you must obtain necessary information from the witness at the accident scene itself. Obtaining the information at the accident scene is important because the witness’s observations of the events will still be fresh and he or she can easily visualize what occurred.
The following is a list of the kind of information you must collect from the individual who witnessed your accident:

  • The name, address and telephone number of the witness.
  • A statement from the witness with the following important information:
  • a. What he or she saw
    b. What he or she heard
    c. Where was he or she during, before and after the incident
    d. How far was he or she from the accident scene
    e. Did he or she have a clear view of the incident
    f. His or her observations about the weather condition at the time of the accident
    g. Any other observations pertaining to the accident that he or she is willing to share
It is important to note that many people may not feel comfortable with making a statement. If this happens, it is advisable that you simply obtain the witnesses’ personal information, so your personal injury lawyer can contact him or her later.
