The Hon’ble High Court of Karnataka, presided over by a single judge bench led by Justice K. S. Hemalekha, in the case of Stone Hill Education Foundation Vs. Union of India & Others, has invalidated the special provisions for 'international workers' as described in paragraph 83 of the Employees’ Provident Funds Scheme, 1952 and paragraph 43A of the Employees’ Pension Scheme, 1955. The Hon’ble High Court of Karnataka has ruled that these provisions are unconstitutional and arbitrary. On January 10, 2024, the Government of Karnataka enacted the Karnataka Compulsory Gratuity Insurance Rules, 2024 (“Gratuity Rules”). Similar rules pertaining to compulsory insurance for covering gratuity payments required under the Payment of Gratuity Act, 1972 (“Gratuity Act”) have already been in force in the states of Andhra Pradesh, Telangana, and Kerala. The Gratuity Rules requires current as well as prospective employers in the State of Karnataka to mandatorily secure insurance for the paying gratuity benefit to all eligible employees.
